For Tenants

Your Health Matters. So Does the Air You Breathe

If you’re a tenant in New York City, you have rights when it comes to indoor environmental hazards like mold, lead, and asbestos. Nova Environmental Group provides independent testing to help ensure your home is safe — even when your landlord doesn’t act.

Know Your Rights:

Lead-Based Paint

  • Buildings built before 1978 are presumed to have lead paint.

  • Your landlord must repair peeling or damaged paint using lead-safe work practices.

  • If a child under 6 lives in your home, an XRF inspection may be legally required.

Mold

  • Landlords must inspect for mold annually and repair leaks or water damage.

  • They must clean up mold properly — not just paint over it.

  • You can call 311 to report conditions if mold isn’t remediated.

Asbestos

  • Asbestos is common in older buildings (pipe wrap, tiles, insulation).

  • If construction is happening nearby and dust is visible, you can request an air quality test.

Warning Signs to Look For:

  • Peeling paint or white dust on window sills

  • Musty smells or visible mold growth

  • Ongoing leaks or water stains

  • Dust or debris during repairs

What You Can Do:

  • Document issues with photos & dates

  • Notify your landlord in writing

  • Call 311 to report serious unresolved problems

  • Request an independent inspection from a certified firm like Nova

  • Or built between 1960–1978 with known lead-based paint
