Asbestos Laws

 Local Law 1 of 2004 (NYC Lead Paint Law)
Applies to buildings with 3 or more units built before 1960, or between 1960–1978 if lead-based paint is known or suspected.
Landlords must:

  • Annually inspect for lead hazards.
     
  • Use safe work practices when disturbing paint.
     
  • Provide lead disclosures to tenants and buyers.
     

Local Law 31 of 2020

  • Requires XRF lead inspections in applicable units.
     
  • All units with a child under 6 must be inspected within 1 year of move-in.
     
  • All applicable units must be inspected by August 2025 — even if no child is present.

 NYS Industrial Code Rule 56

  • Requires asbestos surveys before any renovation, demolition, or major repair.
     
  • Inspections must be done by a licensed NYS Asbestos Inspector.
     
  • Project filing and monitoring may be required depending on the work.
     

OSHA Asbestos Standard (29 CFR 1926.1101)
Employers must assess asbestos exposure risks and ensure worker safety on any job involving potential asbestos disturbance.

 Local Law 55 of 2018 (Indoor Allergen Hazards Law)
Applies to buildings with 3 or more units. Landlords must:

  • Annually inspect for mold and pests.
     
  • Address leaks and mold promptly.
     
  • Use safe work practices and licensed professionals.
     

NYS Mold Law (Article 32 of the Labor Law)

  • Requires separate licensed mold assessors and remediators for any job exceeding 10 sq ft in homes or apartments.
     
  • No one company may assess and remediate the same job.

  • EPA RRP Rule: Contractors working in pre-1978 buildings must be RRP-certified and follow lead-safe work practices.
     
  • HUD Lead-Safe Housing Rule: Federally assisted housing must meet strict lead safety and clearance standards.

Under Local Law 31 of 2020, all NYC landlords must hire an EPA-certified lead inspector or risk assessor to conduct XRF lead inspections in every dwelling unit of:

  • Buildings built before 1960
  • Or built between 1960–1978 with known lead-based paint
